SB 5256: Sexual assault protect order
Concerning sexual assault protection orders.
Summary
Provides that sexual assault protection orders may be permanent, rather than having a two-year maximum. Modifies the procedure for renewal of a sexual assault protection order to require renewal unless the respondent shows that he or she will not engage in or attempt contact with the petitioner after the order expires. Establishes procedures for a respondent to petition to terminate or modify the terms of a sexual assault protection order, including terms related to firearms, dangerous weapons, or concealed pistol licenses. Provides that the crime of Unlawful Possession of a Firearm based on being subject to a court order involving an intimate partner that meets certain criteria does not apply to a person restrained under a sexual assault protection order that has been modified to remove firearms restrictions.
