SB 5880: Toxicology testing

Concerning toxicology testing by certified or accredited laboratories.

Summary

  • Allows certain private laboratories to perform blood or breath tests for impaired driving offenses.
  • Allows a local government to accept donations to access private laboratory testing.
  • Allows a city or county to transfer evidence to a private laboratory if the Washington State Patrol is reimbursed for the costs to transmit the evidence from the State Toxicological Laboratory.
  • Requires a city or county to contract with a private laboratory to address witness interviews and litigation procedure prior to submitting evidence to the laboratory for analysis.
