SB 5981: 340B drug pricing program

Concerning the 340B drug pricing program.

Summary

  • Prohibits a manufacturer or third party acting on behalf of a manufacturer from restricting the acquisition of drugs under the 340B Drug Pricing Program (340B Program).
  • Prohibits a manufacturer or third party acting on behalf of a manufacturer from requiring a covered entity to submit data as a condition for allowing the acquisition of drugs under the 340B Program.
  • Requires certain covered entities and drug manufacturers participating in the 340B Program to annually report information and pay a filing fee to the Health Care Authority.
