BILL · 2025–26 SESSION · LATEST VERSION SSB 6062
SB 6062: Criminal offenses under 18
Modifying provisions related to individuals found to have committed criminal offenses when under the age of 18.
Summary
- Requires the court to grant a suspended disposition alternative when the juvenile is eligible unless the court makes a finding by a preponderance of the evidence that commitment to juvenile rehabilitation is needed because remaining in the community on community supervision would not adequately protect the community and expands juvenile offenses that are eligible for a disposition alternative.
- Reduces the standard range disposition for robbery in the first degree or attempt, and robbery in the second degree if found guilty in juvenile court.
- Requires a mid-point review hearing and possible release by the sentencing court in which the juvenile was adjudicated as long as the juvenile has served at least six months in the custody of the Department of Children, Youth and Families (DCYF) and unless the court does finds that remaining in the community on community supervision would not adequately protect the community.
- Defines "rated bed capacity" and designates placement of certain individuals in Department of Corrections (DOC) institutions when capacity exceeds 100 percent.
- Requires DCYF begin planning and identifying methods to avoid exceeding rated bed capacity when it reaches 90 percent.
- Sets conditions for transition planning.
