Concerning contracts between the United States and county and municipal jails for committing or confining individuals in federal custody.
Summary
Provides discretion to a person in charge of a jail to receive or keep an individual that is confined or committed a person by authority of the United States, and requires the agreement to be in a contract.
Permits a jail to hold a person in federal custody prior to entry of a contract at the jail's discretion provided a contract is created within 180 days of the jail's acceptance of that person, the jail may continue to accept any person in federal custody during this period.
Establishes the contract must include a fee at a rate not less than the daily bed rate established by interlocal agreement.
Clarifies that this act does not prevent a jail from accepting a person in federal custody for confinement or commitment if the jail in it's discretion, determines that there is a reasonable public safety interest to confine or commit the person.
