SB 5852: Immigrant workers

Concerning immigrant worker protections.

Summary

  • Requires an employer to provide multilingual and timely notice to its workers when the employer is notified that a federal agency has scheduled an inspection of worker records and when inspection results are received.
  • Provides that notice of inspection results must include, among other things, a description of any deficiencies, correction timelines, and representation rights.
  • Prohibits employers from voluntarily consenting to a federal agency to access or obtain worker records without a subpoena or warrant.
  • Requires employers to display a poster created by the attorney general (AG) with information about workers' rights by October 1, 2026.
  • Authorizes the AG to investigate potential violations and initiate legal actions, with specified civil penalties.
  • Authorizes specified parties, such as workers and certain organizations, to initiate private causes of action in court.
